1. Acceptance of Terms

These Terms & Conditions ("Terms") form a binding agreement between you and the developer of CloakVPN – Fast & Secure Proxy ("CloakVPN," "the App," "we," "us," or "our") governing your download, installation, and use of the App on iOS, iPadOS, or macOS. By downloading, installing, or using CloakVPN, you agree to these Terms. If you do not agree, do not use the App.

Please also review our Privacy Policy, which is incorporated into these Terms by reference and explains what information the App handles.

2. Description of the Service

CloakVPN is an OpenVPN client application. It allows you to:

• Browse and connect to free, publicly listed servers made available by VPN Gate, a volunteer-operated academic public VPN relay project that we do not own or operate; and/or
• Import and connect to your own OpenVPN (.ovpn) configuration file from any third-party VPN provider of your choosing.

CloakVPN is a client only. We do not operate, own, or control any VPN exit server that your traffic is routed through, whether it's a VPN Gate relay or a server from a config you imported.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use CloakVPN. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian, including for any subscription purchase made through your Apple ID.

4. No Account Required

CloakVPN does not require you to register an account, and we do not maintain a CloakVPN user database. Your subscription entitlement is tied to your Apple ID through Apple's App Store, not to any account we control.

5. Subscriptions, Free Trial & Billing

CloakVPN offers the following, subject to change:

• Free trial: New users may receive a one-time, limited-duration free VPN session (currently up to 10 minutes) before a subscription is required. This trial may be used only once per installation and does not renew or refund by disconnecting early.
• Payment: All subscriptions are purchased and billed through Apple's In-App Purchase system and charged to your Apple ID. Prices are as displayed in the App at the time of purchase and may vary by region.
• Auto-renewal: Subscriptions automatically renew for the same duration unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
• Managing or canceling: You can manage or cancel your subscription anytime in your device Settings → [your name] → Subscriptions. Canceling stops future renewals but does not refund the current period.
• Refunds: All purchases are processed by Apple, and refund requests are handled exclusively by Apple under its own refund policies — we do not have the ability to issue refunds directly.
• Price changes: If subscription pricing changes, we will provide any notice required by the App Store before the change applies to you.

6. Acceptable Use

You agree to use CloakVPN only for lawful purposes. You agree not to:

• Use the App to violate any applicable law or regulation, including in the country where you are physically located or where any server you connect to is located;
• Use the App to transmit malware, engage in fraud, harass others, infringe intellectual property, or access accounts or systems without authorization;
• Attempt to disrupt, overload, or abuse the VPN Gate volunteer relay network or any third-party server you connect to;
• Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent such restriction is prohibited by applicable law;
• Use automated means to scrape, resell, or redistribute the App or the free server list it displays as your own service.

7. Third-Party Servers & Your Own Configs

When you connect through a VPN Gate server, you are using infrastructure run by an independent, anonymous volunteer, not us. When you import your own configuration file, you are using infrastructure run by whatever provider issued that file to you. In both cases:

• We make no representation about that server's uptime, speed, security, jurisdiction, or logging practices;
• Your use of that server is also subject to that operator's own terms and policies, where applicable;
• You are solely responsible for verifying that any configuration file you import comes from a source you trust, and for the consequences of connecting to it.

8. Service Availability

Because VPN Gate servers are run by unpaid volunteers, and because your own imported servers are outside our control, we cannot and do not guarantee that any particular server will be available, fast, or online at any given time. We may also modify, suspend, or discontinue any feature of the App at any time, with or without notice.

9. Intellectual Property

The CloakVPN name, logo, and app design are owned by us or our licensors.

10. Disclaimer of Warranties

THE APP AND ANY SERVERS YOU CONNECT TO THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY THIRD-PARTY SERVER YOU CONNECT TO WILL PROTECT YOUR PRIVACY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PRIVACY, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR ANY THIRD-PARTY SERVER ACCESSED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or your violation of any law or third party's rights.

13. Termination

You may stop using the App at any time and uninstall it, and may cancel any subscription as described in Section 5. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, though because we do not maintain user accounts, this would generally take the form of the App refusing to function rather than a targeted account action.

14. Compliance With Local Law

The App and the servers it can connect to may not be available or legal to use in every country. You are responsible for ensuring that your download, installation, and use of the App, and any server you connect to through it, complies with the export control, sanctions, and other laws applicable to you and your location.

15. Changes to the Service or These Terms

We may update these Terms from time to time to reflect changes to the App or to legal requirements. We will update the "Last Updated" date above when we do, and where a change is material, we will make reasonable efforts to flag it in the App (such as in release notes). Continuing to use CloakVPN after an update constitutes acceptance of the revised Terms.

16. Governing Law & Disputes

These Terms are governed by the laws applicable in your country or state of residence, without regard to conflict-of-law principles, except where a mandatory local consumer-protection law provides otherwise. Nothing in these Terms limits any statutory right you may have as a consumer that cannot be waived under the law of your jurisdiction. If you have a dispute with us, please contact us first at the address in Section 18 so we can try to resolve it informally.

17. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App, and supersede any prior agreements on this subject.
• No waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Apple as third-party beneficiary: You acknowledge that Apple Inc. is not a party to these Terms but is a third-party beneficiary of them with respect to your license to use the App, and may enforce these Terms against you as such a beneficiary.
